About
Taking a cultural approach to comparative law methodology, my research has explored the fundamental principles of Islamic contract law, in order to develop a suitable model of financial option, alternative to khiyār ash-sharṭ and al-‘urbūn: the solution has been found in an ijāra wa-hiba structure (payment of rent for the usufruct of the underlining asset, instead of the initial option premium; eventual transfer through donation with contextual compensation), with a function limited to the mitigation of risk.
